İkinci kısım 12’nci maddeden 74’üncü maddeye kadar sürmekte ve toplam 62 adet maddeyi içermektedir. Şüphesiz ki bu 62 maddenin hepsinin ayrı bir önemi vardır. Ancak bu maddelerden biri en önemlisidir. Bu madde, 13’üncü maddedir. 13’üncü madde temel hak ve hürriyetlerin sınırlandırılması sistemini belirleyen bir çerçeve madde niteliğindedir. 13’üncü maddede öngörülen şartlar, bütün diğer maddelerde düzenlenen temel hak ve hürriyetlere uygulanabilir niteliktedir. Temel hak ve hürriyetlerin sınırlanması, 13’üncü maddenin öngördüğü şartlar ve sınırlar dahilinde mümkündür. Temel hak ve hürriyetlerin sınırlanmasının güvenceli bir sisteme bağlanıp bağlanmadığı 13’üncü maddedeki şartlara göre belirlenir. Temel hak ve hürriyetlerin gerekli bazı durumlarda sınırlanıp sınırlanamayacağı yine 13’üncü maddedeki ölçütlere göre tayin edilir. İşte böylesine önemli olan 13’üncü madde, 3 Ekim 2001 tarih ve 4709 sayılı Türkiye Cumhuriyeti Anayasanın Bazı Maddelerinin Değiştirilmesi Hakkında Kanunla[1] değiştirilmiştir. Bu makalede Anayasa değişikliğiyle 13’üncü maddede ne gibi değişiklikler yapıldığı, bu değişikliklerin neler getirdiğini ve neler götürdüğünü incelemeye çalışacağız. İlk önce 13’üncü maddenin eski şekline göre temel hak ve hürriyetlerin sınırlandırılması sistemini kısaca hatırlatacağız. Daha sonra da, 13’üncü maddenin yeni şekline göre temel hak ve hürriyetlerin sınırlandırılması sistemini inceleyeceğiz. 13’üncü Maddenin Eski Şekli.- İlk önce 13’üncü maddenin ilk şeklini görelim: “Temel hak ve hürriyetlerin sınırlanması MADDE 13.- Temel hak ve hürriyetler, Devletin ülkesi ve milletiyle bölünmez bütünlüğünün, millî egemenliğinin, Cumhuriyetin, millî güvenliğin, kamu düzeninin, genel asayişin, kamu yararının, genel ahlâkın ve genel sağlığın korunması amacı ile ve ayrıca Anayasanın ilgili maddelerinde öngörülen özel sebeplerle, Anayasanın sözüne ve ruhuna uygun olarak kanunla sınırlanabilir. Temel hak ve hürriyetlerle ilgili genel ve özel sınırlamalar demokratik toplum düzeninin gereklerine aykırı olamaz ve öngörüldükleri amaç dışında kullanılamaz. Bu maddede yer alan genel sınırlama sebepleri temel hak ve hürriyetlerin tümü için geçerlidir”. Görüldüğü gibi 13’üncü maddenin ilk şekli, temel hak ve hürriyetlerin sınırlandırılmasını bazı şartlara bağlamıştı. Bu şartlar şunlardı[2]: 1. Sınırlama kanunla olmalıdır. 2. Sınırlama Anayasanın sözüne ve ruhuna uygun olmalıdır. 3. Sınırlama (a) “genel sınırlama sebeplerine” veya (b) “anayasanın ilgili maddesinde öngörülen özel sebeplere” dayanmalıdır. 4. Sınırlama “demokratik toplum düzeninin gerekleri”ne aykırı olmamalıdır. 5. Sınırlama öngörüldüğü amaç dışında kullanılmamalıdır. Şimdi de 13’üncü maddenin 3 Ekim 2001 tarih ve 4709 sayılı Türkiye Cumhuriyeti Anayasanın Bazı Maddelerinin Değiştirilmesi Hakkında Kanunla[3] değiştirilmiş şeklini görelim: Anayasa değişikliğinden sonra 13’üncü madde şu hâle gelmiştir: “Temel hak ve hürriyetlerin sınırlanması MADDE 13.- Temel hak ve hürriyetler, özlerine dokunulmaksızın yalnızca Anayasanın ilgili maddelerinde belirtilen sebeplere bağlı olarak ve ancak kanunla sınırlanabilir. Bu sınırlamalar, Anayasanın sözüne ve ruhuna, demokratik toplum düzeninin ve lâik Cumhuriyetin gereklerine ve ölçülülük ilkesine aykırı olamaz.” 13’üncü maddenin yeni şekline göre temel hak ve hürriyetlerin sınırlandırılmasının şartları şunlardır: 1. Sınırlama kanunla olmalıdır. 2. Sınırlama Anayasanın sözüne ve ruhuna uygun olmalıdır. 3. Sınırlama anayasanın ilgili maddesinde belirtilen sebeplere bağlı olmalıdır. 4. Sınırlama temel hak ve hürriyetlerin özlerine dokunmamalıdır. 5. Sınırlama “demokratik toplum düzeninin gerekleri”ne aykırı olmamalıdır. 6. Sınırlama “lâik Cumhuriyetin gerekleri”ne aykırı olmamalıdır. 7. Sınırlama “ölçülülük ilkesi”ne aykırı olmamalıdır. 13’üncü maddenin eski şekliyle yeni şekli arasında benzerlikler ve farklılıklar vardır.
