What Habeas Corpus does is it prevents the government from imprisoning you without reason and from keeping you there indefinitely. When it’s suspended, the government can arrest and jail anyone for any reason and detain them indefinitely without trial and without charging them for a crime. It’s essentially suspending the constitution because the President can now act authoritarian without checks and balances. Judge rules against him? Jail. Congressman votes against him? Jail. A Reporter is too critical? Jail. This is a big deal and this puts Americans in extreme danger from their own government. This has happened four times in American history – During the civil war, during the KKK counterterrorism campaign, in the Philippines during the 1905 insurrection, and in Hawaii after Pearl Harbor. Congress has to approve the suspension of Habeas Corpus, but the first time it was ever used was by Lincoln who did it unilaterally. He suspended it on his own at the start of the war and a huge legal battle ensued, and the Supreme Court ruled that only Congress can suspend it - but Lincoln ignored the ruling and kept it suspended. The way Stephen Miller talked about this this afternoon suggests that Trump will act unilaterally like Lincoln.
